Along with our good friend A. Scott Waddell, our firm represented the heirs of the deceased in a legal malpractice case against their mother's former attorney. The attorney originally brought a nursing home case, which was dismissed and refiled. However, plaintiff alleged that the attorney did not perfect service of process against the medical malpractice defendants, resulting in the underlying medical malpractice case being dismissed. Plaintiffs also alleged that the attorney failed to sue the proper defendant, including a Missouri nursing home which failed to identify and treat their mother as having an increased risk for a pulmonary embolism. The plaintiffs' mother's death certificate revealed the pulmonary embolism due to a deep vein thrombosis was the cause of death. The claim was settled against the lawyer since the statute of limitations against the health care providers had expired.
