On June 15 at approximately 4:00 am, Lynn Seegmiller was driving a freightliner truck hauling grain. Two horses owned by Richard Cullum ran in front of the semi-truck. The plaintiff struck one horse, ran over the horse with the driver's side tires and was forced into the ditch, where the truck fell onto the passenger side. Lynn was violently thrown into the passenger side door.

Lynn injured his right shoulder and will need a rotator cuff surgery. Additionally, he was unable to return to work full time as a truck driver and suffered considerable lost wages. The personal injuries and lost income had a major impact on this family farmer.

The case settled for the $100,000 policy limits, minus $2,000 which was already paid by the insurance carrier to a local government for damage to the roadway.
