Paul and Carolyn Lero sued Robert Lyons for the death of their daughter Denise Marie Greene on a theory of negligent entrustment.

On October 11, 2008, Ms. Greene was driving on 291 Highway near CRD Home Farm Road in Cass County, Missouri. Adam Mace was driving a gold 2007 Toyota Corolla, on Highway 291 near Farm Home Road in Cass County, Missouri. The Corolla was owned by his step-father Robert Lyons. Mr. Mace was speeding at the time and was under the influence of alcohol. Additional evidence regarding prior arrests and tickets was introduced at trial. Adam Mace collided with Denise Greene causing severe injuries. On October 14, 2008, Denise Marie Greene passed away as a result of the severe injuries she sustained from the accident.

During the trial plaintiffs presented testimony from Dr. Kenneth Hubbell, an economist. Dr. Hubbell testified that the plaintiffs suffered a total present value loss of $639,210. After hearing all the evidence, the judge found in favor of the plaintiffs and awarded $2,000,000 in damages. After the judgment was entered, suit was brought against State Farm for underinsurance, an umbrella policy and vexatious refusal to pay.
